J-Body IRC Acceptable Use
Policy

Part I
- Introduction
This Acceptable Use Policy (AUP) governs the use of computers and servers on the
J-Body Internet Relay Chat Network. As a user of these resources, you are responsible for reading and understanding this document. This document
protects the users of J-Body IRC network, computing hardware and networks, and system
administrators.
J-Body IRC administration reserves the right to alter this AUP and any terms and conditions of
service at any time without prior notice. However, a notice will be posted
in the General Forum on www.j-body.org at least 10 days in advance of such
changes if possible. Notice is deemed given when posted.
The J-Body IRC AUP is under constant review. We consider comments from our users and from experienced staff. We will change this document from time to
time. You are subject to the AUP in effect at the time you use any J-Body
IRC
resource/service, and to each revision of the AUP that becomes effective subsequently.
- Rights and Responsibilities
This network can provide access to resources locally, as well as the ability to communicate with other users worldwide. Such open access is a
privilege and requires that individual users act responsibly. Users must respect the rights of other users, respect the integrity of the systems and
related physical resources, and observe all relevant laws, regulations, and contractual obligations. Since electronic information is volatile and
easily reproduced, users must exercise care in acknowledging and respecting the work of others through strict adherence to software licensing
agreements and copyright laws.
You will indemnify and hold harmless J-Body IRC, it's resource providers, officers, shareholders, and other agents from any and all claims, costs,
expenses, judgments, causes of action, attorney fees, litigation and court costs, resulting from the subscriber's use of
J-Body IRC services in any manner, whether directly or indirectly or by any act of omission or
commission.
You are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules and regulations pertaining to
(i) your use of any J-Body IRC service; (ii) the communications means by which you connect your
terminal, personal computer or other device to J-Body IRC services or to any
service provided to and by J-Body IRC; and (iii) the local J-Body IRC server you
connect to as stated or referenced to in its Message of the Day (/motd).
Your rights herein granted cannot be transferred, shared, sold or used by anyone other than yourself.
J-Body IRC has the right to delete ALL data files, or other information that is
stored in any database operated by a J-Body IRC officer or under the auspices
of J-Body IRC once your nick/channel's registration has been terminated, by either you or
J-Body IRC.
No warranty is made by J-Body IRC regarding any information, services or products provided through, in connection with, or located on the computer
systems owned by, or operated under the auspices of, J-Body IRC or any other
services provided by J-Body IRC, and J-Body IRC hereby expressly disclaims any and
all warranties, including without limitation (i) any warranties as to the availability, accuracy, or content of information, products, or services;
and, (ii) any warranties of merchantability or fitness for a particular
purpose.
J-Body IRC shall have no liability for damages caused or allegedly caused by
any failure of performance, error, omission, interruption, electrical surge or damage or interference, deletion, defect, delay in operation or
transmission, communication line failure.
No agent, officer, or representative of J-Body IRC has any authority to bind
J-Body IRC to any affirmation, representation, or warranty concerning the services provided by
J-Body IRC.
- Existing Legal Context
Users are not entitled to their nickname and channel registrations but, once
registered, are granted the privilege of exclusive use. Though
J-Body IRC is not solely used by persons in the United States, J-Body IRC has decided to adopt many its laws and
practices. This includes the Electronic Communications Privacy Act of 1986 (Title 18 U.S.C. section 2510 et. seq.) through which users are entitled to
privacy regarding information contained within their NickServ/ChanServ/MemoServ accounts (including memos and passwords). This
act, however, allows system administrators or IRC operators to access this information in the normal course of their duties when necessary to protect
the integrity of computer systems or the rights or property of J-Body IRC.
J-Body IRC will also act in accordance to Title 18 U.S.C Part 1 Chapter 110 section 2251 "Sexual exploitation of children" subsection (c) which states:
(1) Any person who, in a circumstance described in paragraph (2),
knowingly makes, prints, or publishes, or causes to be made, printed, or published, any notice or advertisement seeking or offering -
(A) to receive, exchange, buy, produce, display, distribute, or
reproduce, any visual depiction, if the production of such visual depiction involves the use of a minor engaging in sexually
explicit conduct and such visual depiction is of such conduct; or
(B) participation in any act of sexually explicit conduct by or
with any minor for the purpose of producing a visual depiction of such conduct; shall be punished as provided under subsection (d).
(2) The circumstance referred to in paragraph (1) is that -
(A) such person knows or has reason to know that such notice or
advertisement will be transported in interstate or foreign commerce by any means including by computer or mailed; or
(B) such notice or advertisement is transported in interstate or
foreign commerce by any means including by computer or mailed.
Misuse of computing, network or information resources may result in the loss of network access and/or contact made to the abuser's service
provider. Additionally, misuse can be prosecuted under applicable statutes. Illegal distribution of software and other intellectual property protected
by copyright law is subject to civil damages and criminal punishment including fines and imprisonment.
J-Body IRC is in full support of the details laid out in Title 17 U.S.C "Copyrights".
- Enforcement
Minor infractions of this policy, when accidental, such as connecting multiple clients, or flooding, are generally resolved informally by a
network operator and may result in temporary removal from the network (/kill) or dealt with through electronic mail or on-line discussion and
education.
Repeated minor infractions or misconduct which is more serious may result in the temporary or permanent loss of network access privileges (k-line) or
the modification of those privileges. More serious violations include, but are not limited to unauthorized use of
NickServ/ChanServ accounts, attempts to steal passwords or data, repeated harassment, or threatening
behavior. In addition the offender's internet service provider will most likely be informed.
Part II
Conduct which violates this policy includes, but is not limited to the activities in the following list.
- Unauthorized use of a ChanServ or Nickserv account.
- Using J-Body IRC to gain unauthorized access to any computer systems.
- Connecting unauthorized servers to the network.
- Unauthorized attempts to circumvent data protection schemes or uncover
Security loopholes. This includes creating and/or running programs
that are designed to identify security loopholes and/or decrypt intentionally secure data.
Knowingly or carelessly performing an act that will interfere with the
normal operators of computers, servers, or clients.
Knowingly or carelessly running any program intended to damage or to
place excessive load on a server or the networks. This includes, but is not limited to, mass-invites, mass-messages, and programs known as
floodbots and clonebots.
Advertising the distribution of pornographic material related to
minors.
Advertising the illegal distribution of copyrighted software, text,
images, etc.
Connecting an automated client (bot, fserv, etc..) to a
J-Body IRC server without prior authorization by that server's administration.
Using J-Body IRC resources for commercial activity, such as advertising or
selling a product, without prior approval of the J-Body IRC administration.
Forging the identity of a user or machine in an electronic
communication.
Intentionally changing IRC-identifiable
information (host address, ident, etc) that will allow you to re-gain access
to a channel you are banned from or circumvent an /ignore placed against you
by another user.
Displaying obscene, lewd, or sexually harassing images or text on a
public channel without the prior consent of that channel's operators.
Intentionally repeating or transmitting material in a rapid manner
producing the affect of harassing a user by "flooding" them.
Attempting to monitor or tamper with another user's electronic
communications, or reading, copying, changing, or deleting any part of another user's NickServ/ChanServ/MemoServ account without the explicit
agreement of the owner.
These policies govern the use of the IRC service provided by
J-Body IRC, and the use of the Chanserv/Nickserv/Memoserv services provided as a
convenience to the users. Additional rules and policies in individual
channels can be determined by the founder of that channel and enforced by the
operators of that channel. Violation of the rules specific to a channel,
even those not contained herein, is considered a violation of the terms set
forth in this AUP and can be dealt with accordingly. IRC Operators and
Server Administrators will only become involved in the policies or operation
of individual channels at the request of the channel Founder or Operators.
Exceptions to this are the channels designated as "Server
Channels". These include the General Chat channel, #jbody, and the
channels set up for each of the Discussion Forums on www.j-body.org.
These channels are governed by the policies contained in this AUP as well as
those listed in "Server Channel Rules".
